Terms of Service
Last updated October 22, 2026
These terms are an agreement between Carretta Holdings LLC, doing business as HaulKeep ("HaulKeep", "we") and the business that creates a HaulKeep account ("you"). By creating an account or using HaulKeep you agree to them and to our Privacy Policy. If you accept for a company, you confirm you have the authority to do so.
1. What HaulKeep does
HaulKeep is software for motor carriers. It helps you see which DOT safety records your operation needs, store them, track due dates, send tasks to drivers, and produce an audit binder. Features may change as we improve the service. We'll tell you in advance before removing a major feature you pay for.
2. Not legal advice, and no guarantee of compliance
HaulKeep is an organizing tool. Its checklists, templates (including the drug and alcohol policy template), reminders and explanations are general information based on federal rules. They are not legal advice and don't replace reading the regulations or getting professional advice for your situation. State rules, hazardous materials, passenger carriage and other special cases may need more than HaulKeep covers.
You remain responsible for your company's compliance, including keeping required records for the required time, running required queries and tests, and acting on the results. HaulKeep doesn't guarantee any audit outcome, safety rating or enforcement result.
HaulKeep is not affiliated with, endorsed by or connected to the Federal Motor Carrier Safety Administration (FMCSA), the U.S. Department of Transportation (USDOT) or the FMCSA Drug and Alcohol Clearinghouse.
3. Your account
- Give accurate information and keep it up to date.
- Keep your password private and turn on two-step sign-in. You're responsible for activity in your account; tell us right away if you think it has been misused.
- Accounts are for businesses. You must be at least 18.
- You agree to receive records, notices and disclosures electronically, as you confirmed when you set up the account.
4. Your drivers' information
When you add drivers and their records, or send them tasks, you confirm that:
- you have a lawful reason and any required notices or consents to collect and store their information, including what FMCSA rules require you to keep;
- you'll send email or text tasks only to drivers who work for or are applying to you, and texts only to drivers who have agreed to receive them;
- you'll use HaulKeep for your own compliance records, not for unrelated purposes.
HaulKeep stores and processes driver information for you, as described in the Privacy Policy.
5. Plans, billing and cancellation
- Subscriptions are billed monthly in advance through Stripe, at the price shown when you subscribe: currently $29 a month (Standard), or $19 a month for Founding members with a valid founding code. The Founding plan includes one free first month per company.
- Your subscription renews automatically each month until you cancel. You can cancel at any time from the Billing page; you keep access until the end of the month you've paid for. We don't give refunds for partial months, except where the law requires.
- If a payment fails, you keep full access for 7 days while you update your card. After that the account becomes read-only: you can still see your records, make the audit binder and export your data, but not add or change records until payment is made.
- We may change prices with at least 30 days' notice by email. A new price applies from your next billing month after the notice period, and you can cancel before it does.
- Prices don't include taxes, which are added where required.
6. Your data
Your records belong to you. You give HaulKeep permission to store, process and display them only to provide and support the service for you. We don't sell your data or use it for advertising.
You can download a complete export at any time, in any plan state. If you delete your account, your data is held for 30 days and then permanently deleted, as the Privacy Policy describes. Please export anything you need before then.
7. Acceptable use
You agree not to:
- upload information you have no right to use, or anything unlawful, false or harmful;
- access another company's account or data, or try to get around HaulKeep's security or access rules;
- interfere with the service, overload it, or use automated tools to scrape it;
- copy, resell or reverse-engineer HaulKeep, or use it to build a competing product;
- send unsolicited messages through HaulKeep's email or text features.
We may suspend an account that breaks these rules or puts the service or other users at risk, and we'll tell you why when we can.
8. Availability and support
We work to keep HaulKeep available and your data safe, including daily backups, but we can't promise the service will never be interrupted or error-free. Planned maintenance will be kept short. Contact support@haulkeep.app for help.
9. HaulKeep's software and content
HaulKeep, its software, design, checklists and templates belong to Carretta Holdings LLC. While your subscription is active you may use them for your own business, including the documents HaulKeep generates for you (such as your adopted drug and alcohol policy and audit binders), which you may keep and use after your subscription ends. If you send us feedback, we may use it without obligation to you.
10. Disclaimers
Except as these terms say otherwise, HaulKeep is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and any warranty that the service's information is complete or current. Reminders depend on the dates entered and on email and text delivery, which can fail; don't rely on them as your only way of tracking deadlines.
11. Limitation of liability
To the extent the law allows, HaulKeep won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, or for fines, penalties or out-of-service orders, even if we were told they were possible. Our total liability for any claim about the service is limited to the amount you paid HaulKeep in the 12 months before the claim arose. Some places don't allow these limits, so they may not apply to you in full.
12. Responsibility for claims
You agree to defend and compensate HaulKeep for third-party claims arising from information you put into HaulKeep without the right to do so, from your use of the service in breach of these terms, or from your violation of law, including claims by your drivers about how you handled their information.
13. Ending the agreement
You can stop using HaulKeep and delete your account at any time. We may end these terms or close an account with 30 days' notice, or right away for a serious breach. You'll be able to export your data before an account we close is deleted, unless the law prevents it. Sections that by their nature should survive (such as disclaimers, limits of liability and responsibility for claims) continue after the agreement ends.
14. Changes to these terms
We may update these terms. For material changes we'll email account owners at least 30 days before they take effect. Continuing to use HaulKeep after that means you accept the new terms; if you don't, you can cancel before they take effect.
15. Governing law
These terms are governed by the laws of the State of Virginia, without regard to its conflict-of-law rules. Courts located in Virginia have exclusive jurisdiction, and both sides agree to them. Before filing a claim, please contact us at support@haulkeep.app so we can try to resolve it informally.
